2. PURPOSES AND GROUNDS OF LEGITIMIZING THE PROCESSING OF YOUR PERSONAL DATA

Clinique will process your personal data for various purposes, which are based on different legal bases:

A. Processing on the basis of Clinique’s legal obligations

The following data processing is based on the fact that it is necessary in order to comply with a legal obligation that Clinique is required to comply with, in accordance with art. 6.1.c) of the RGPD.

• Attention to the exercise of rights

Purpose: respond to queries, complaints and claims made to Clinique. In compliance with article 12 of the RGPD and the LOPDGDD, Clinique, as Data Controller of your personal data, is required to respond to the exercise of the data protection rights that you may exercise.

B. Processing based on legitimate interests

These processing operations have as their legal basis the satisfaction of legitimate interests pursued by Clinique, or by a third party, provided that such interests are not overridden by your interests or your fundamental rights and freedoms, as set out in Article 6.1f) of the GDPR.

The carrying out of such processing will involve Clinique having carried out a balancing of your rights against Clinique’s legitimate interest, taking into account your reasonable expectations based on your relationship with Clinique.

Purpose: through the “Contact us” form, to respond to queries, complaints and claims that you may make to Clinique.

• Carrying out commercial actions on Clinique’s services with third parties

Purpose: to promote the services offered by Clinique.

Provided that you don’t object and you maintain some kind of direct relationship with Clinique, you may receive by any communication channel, including electronic means, information about the services offered by Clinique (new treatments, health tips and news from the clinic) by Clinique that may be of interest to you, in order to keep you informed about the latest developments. In this regard, the Spanish Law on Information Society Services (“Ley 34/2002, de 11 de julio, de servicios de la sociedad de la información y de comercio electrónico”) allows the provider to send commercial communications concerning products or services of its own company that are similar to those that were initially contracted with the customer.

For this purpose, we inform you that your personal data may be analyzed in order to draw up a profile with the same that allows these communications to be adjusted as closely as possible to your needs and preferences.

C. Consent-based processing

The legal basis for these processing operations is the consent provided by you, in accordance with art. 6.1.a) of the GDPR. You may withdraw your consent at any time by writing to Clinique through one of the channels detailed in Section 7.

• Contact via the forms offered on the Clinique website

Purpose: to inform and respond to your request for contact, management or processing of your queries regarding the services offered by Clinique, on the basis of the consent given by you by completing the form and sending it voluntarily.

Clinique processes various personal data in order to manage its relationship with you. For your convenience, Clinique has divided the data it will process into the categories set out below:

• Identifying information: first name(s), surname(s), date of birth, nationality.

Clinique relies on the cooperation of third party providers with access to personal data located outside the European Economic Area, who are Clinique’s processors, as a result of a service relationship.

6. TIME LIMITS FOR THE STORAGE OF YOUR PERSONAL DATA

Clinique will retain the information it collects about you only for as long as is necessary for the purposes set out in Section 2, provided that, where required by law, you do not exercise your right of suppression or withdraw your consent. After that, your personal data will be kept blocked for the legally stipulated retention periods or statute of limitations, as necessary for the formulation, exercise or defence of potential claims. After such periods, Clinique will destroy your personal data.
